1. Overview
Welcome to Tiny Riots. The terms “we”, “us” and “our” refer to Tiny Riots, operated under HG Family Trust, ABN 43 168 654 929.
We operate this website and online store, including its information, content, products, features and services (the “Services”). Our store is hosted by Shopify, which provides the ecommerce platform that allows us to offer our products to you.
These Terms of Service, together with our Privacy Policy, Refund Policy and Shipping Policy, explain your rights and responsibilities when using our Services. By accessing our website or placing an order, you agree to these Terms. If you do not agree, please do not use the Services.
Nothing in these Terms excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law or any other rights that cannot lawfully be excluded.
2. Eligibility and account information
You must be at least 18 years old, or have the permission and supervision of a parent or legal guardian, to place an order.
You agree to provide accurate, current and complete contact, billing and delivery information. You are responsible for maintaining the security of your account details and for activity undertaken through your account.
3. Our handmade products
Tiny Riots products are handmade in small batches or made to order. Timber and plywood are natural materials, so variations in grain, colour, texture, knots, markings and finish are expected. Small internal voids may also be visible along plywood edges. Minor handmade characteristics that do not affect a product’s safety or intended use are not faults. Each item is unique and may vary slightly from website photographs.
We make reasonable efforts to display colours and products accurately. However, colours may appear differently depending on your screen and settings.
Product measurements are approximate unless expressly stated otherwise. Product descriptions, designs, materials, availability and prices may be updated or discontinued without notice. Changes will not affect an order we have already accepted unless we contact you and obtain any consent required by law.
4. Product safety and use
Unless a product page clearly states otherwise, Tiny Riots toys and play products are intended for children aged 3 years and over and must be used under active adult supervision.
Customers must follow all safety, care, cleaning and use instructions supplied with the product or displayed on the relevant product page. Check products before every use and stop using them immediately if they become damaged, cracked, splintered, loose or otherwise unsafe.
Products must only be used for their intended purpose. Any accessories, loose parts or toys shown in photographs but not listed in the product description are not included.
These safety terms do not exclude or limit our responsibilities under the Australian Consumer Law or applicable product safety laws.
5. Orders and acceptance
Placing an order is an offer to purchase. An order is accepted once payment has been successfully processed and we send an order confirmation, subject to product availability and our ability to fulfil the order.
We may decline or cancel an order where reasonably necessary, including because of a pricing or listing error, suspected fraud, an unavailable product or material, an unsupported delivery destination, or our inability to safely or lawfully supply the order. If we cancel an order after payment, we will provide a refund to the original payment method.
Please check product choices, quantities, personalisation and delivery details carefully before ordering. Because our products are made to order, changes or cancellations cannot be guaranteed once production has started. Change-of-mind requests are handled under our Refund Policy.
Products are sold for personal or household use unless we have agreed otherwise in writing. They must not be commercially copied, reproduced or resold as Tiny Riots products without our permission.
6. Made-to-order timeframe
All Tiny Riots products are made to order unless expressly marked otherwise. Please allow approximately two weeks for production before dispatch. This is an estimate and may vary during busy periods or if unexpected material or production delays occur.
If an item is already completed and available, we may dispatch it earlier. We make each product carefully and do not rush the handmade production process.
Choosing Express Post does not provide express or priority production. Express delivery only applies after the order has been completed and dispatched.
If we become aware that we cannot supply an order within the stated timeframe or a reasonable time, we will contact you and provide an appropriate solution consistent with Australian Consumer Law.
7. Prices and payment
Unless stated otherwise, all prices are displayed in Australian dollars. Applicable GST will be included where required by law. Shipping, customs duties, import taxes and other destination charges are additional unless expressly stated otherwise.
Prices and promotions may change without notice, but changes will not affect accepted orders. If a clear pricing or listing error affects an order, we may contact you to confirm whether you wish to proceed at the correct price or receive a refund.
You confirm that you are authorised to use the payment method supplied and that the information you provide is accurate. Payments are processed through Shopify and its supported payment providers.
8. Shipping and delivery
Shipping charges are calculated at checkout based on parcel weight, size and destination. As a small handmade business, we are unable to offer free or discounted shipping unless specifically advertised.
Delivery estimates begin after dispatch and are separate from our production timeframe. Carrier timeframes are estimates and may be affected by postal disruptions, weather, customs or other circumstances outside our reasonable control.
We currently do not ship to the United States or countries within the European Union. Orders placed with an unsupported delivery address may be cancelled and refunded.
International customers are responsible for customs duties, import taxes and processing fees charged by the destination country. International postage is calculated by weight and destination.
Full details are available in our Shipping Policy. Nothing in these Terms transfers responsibility in a way that excludes your rights under Australian Consumer Law.
9. Returns, refunds and consumer guarantees
Our products come with automatic guarantees under the Australian Consumer Law. If a product is faulty, unsafe, significantly different from its description or not fit for its intended purpose, you may be entitled to a repair, replacement, refund or another remedy depending on the circumstances.
For a major problem, you may choose a replacement or refund. For a minor problem, we may first provide a free repair within a reasonable time. We may request proof of purchase, photographs and, where reasonable, return of the item so we can assess the issue.
We do not offer refunds or exchanges simply because you change your mind, make an incorrect selection or no longer want a made-to-order item. This does not affect your rights where a product fails to meet a consumer guarantee.

10. Intellectual property
Unless otherwise stated, the website and its content—including the Tiny Riots name, logos, original product designs, photographs, videos, illustrations, graphics, text and branding—are owned by or licensed to Tiny Riots and are protected by Australian and international intellectual property laws.
You may access the website for personal, non-commercial use. You must not reproduce, copy, modify, manufacture from, distribute, sell, publish or commercially exploit our content or original product designs without our prior written permission.
Shopify’s names, logos and trademarks belong to Shopify or its licensors. Other third-party names and trademarks belong to their respective owners.
11. Third-party services and links
Our Services may include tools, payment services or links provided by third parties. Their use may be subject to separate terms and privacy policies. We do not control third-party websites and are not responsible for their content, accuracy, availability or practices.
Nothing in this section limits any responsibility we have under applicable law for the products or Services we supply.
12. Relationship with Shopify
Tiny Riots is powered by Shopify, which provides our ecommerce platform. Purchases made through our store are transactions directly between you and Tiny Riots. Shopify is not the seller of our products and is not responsible for fulfilling Tiny Riots orders or handling product remedies.
This section does not limit any rights you may have against Shopify under applicable law in relation to services Shopify separately provides to you.
13. Privacy
Personal information collected through the Services is handled in accordance with our Privacy Policy [insert Privacy Policy link]. Shopify also collects and processes certain information to host and operate our store. You can read Shopify’s privacy information at https://www.shopify.com/legal/privacy/app-users.
Information may be processed by Shopify and other service providers located outside Australia. Please review our Privacy Policy for further details.
14. Reviews, feedback and user content
If you submit a review, photograph, suggestion or other content to us, you confirm that you own it or have permission to submit it and that it is accurate, lawful and does not infringe another person’s rights.
You give us a non-exclusive, worldwide, royalty-free licence to use, reproduce and display that content for operating, improving and promoting Tiny Riots. We will handle personal information contained in submissions in accordance with our Privacy Policy.
We may remove content that is unlawful, misleading, abusive, offensive, infringes another person’s rights or is otherwise inappropriate. We are not required to publish or respond to submitted content.
15. Errors and availability
Occasionally, website information may contain errors or omissions relating to product descriptions, pricing, availability, promotions, shipping charges or estimated timeframes. We may correct or update this information.
If an error materially affects an order you have placed, we will contact you and provide any choice or remedy required by law. We will not substitute a materially different product without your agreement.
16. Prohibited uses
You must not use the Services to:

We may restrict or terminate access where we reasonably believe these Terms have been materially breached or unlawful activity has occurred.
17. Availability of the website
We aim to keep the website available and information accurate, but we do not guarantee uninterrupted or error-free access. We may suspend or change parts of the website for maintenance, security or operational reasons.
To the extent permitted by law, general website information is provided for informational purposes and should not be relied upon as professional advice.
Nothing in this section excludes any guarantee, warranty or liability that cannot lawfully be excluded, including under Australian Consumer Law.
18. Limitation of liability
To the maximum extent permitted by law, Tiny Riots is not liable for indirect or consequential loss that was not reasonably foreseeable and was not caused by our breach, negligence or unlawful conduct.
Nothing in these Terms excludes, restricts or modifies:

the consumer guarantees or remedies available under the Australian Consumer Law;

liability that cannot lawfully be excluded or limited;

liability for our fraud, wilful misconduct or negligence where exclusion is not permitted; or

any right to compensation for reasonably foreseeable loss or damage arising from a failure to meet a consumer guarantee.
19. Suspension and termination
You may stop using the Services at any time. We may suspend or terminate access if you materially breach these Terms, misuse the Services or engage in suspected unlawful or fraudulent activity.
Termination does not affect rights or obligations that arose before termination. Provisions that are intended to continue—including intellectual property, privacy, liability, governing law and accrued payment obligations—will survive termination.
20. Severability and waiver
If any part of these Terms is found to be invalid or unenforceable, it will be removed or limited only to the extent necessary. The remaining Terms will continue to apply.
If we do not immediately enforce a provision, that does not mean we waive our right to enforce it later.
21. Entire agreement and assignment
These Terms and the policies referenced in them form the agreement between you and Tiny Riots regarding use of the Services and purchases through our store.
You may not transfer your rights or obligations under these Terms without our written consent. We may assign our rights and obligations as part of a genuine sale, restructure or transfer of the business, subject to applicable law and without reducing your existing rights.
22. Governing law
These Terms are governed by the laws of Western Australia and the Commonwealth of Australia. You and Tiny Riots submit to the courts and tribunals with jurisdiction in Western Australia, subject to any rights you have to bring a claim in another jurisdiction under applicable consumer law.
23. Changes to these Terms
We may update these Terms by publishing a revised version on this page. Material changes will apply from the date stated in the updated Terms and will not retrospectively reduce rights relating to an order already accepted.
